Evolving Cyber Risks Underscore Need for Privacy Counsel in Your Corner

The staggering volume of emerging cyber threats today and the means by which more traditional “cyber” or data security and privacy incidents are presenting themselves mandate now more than ever that trusted privacy counsel be part of your organization’s “pre” as well as “post” incident planning and response efforts. Apart from the organization, efficiency and appropriateness of whatever “pre” incident risk management and risk mitigation efforts are undertaken, privacy counsel can ensure that your organization’s best efforts do not become unintended missteps after the fact by seeking to secure attorney-client privilege around such activity and discussions; preventing your best efforts from potentially being discoverable in subsequent litigation and/or government inquiry down the road, and possibly taken out of context or otherwise used against your organization. While no one wants to think about being sued or “Monday Morning Quarterbacked” as to their pre-or post incident response efforts, the reality today is that lawsuits and government audit/enforcement are becoming more or less a given in the wake of what is now accepted as “the inevitability” of data security and privacy incidents or breaches.
